Terms of Sales

1. Scope and boundaries. The general conditions of sale apply exclusively to existing trade relations:

Hâpy Collection is a trademark of CARRHURE, headquarters located at Hapy-Collection C/O CARRHURE, 12-14 Rond-Point des Champes-Elysées 75008 Paris registered with the RCS Paris 750 716 00014;

Website http://www.hapy-collections.com.

Accordingly, the fact of a natural or legal person, to order on the website of Hâpy Collection wins full acceptance of these terms and conditions. The products displayed on our website are sold online exclusively to customers residing in France.

2. Order

2.2 Who can order?
You must be 18 years or older and be able to contract.

2.3 Validation of the order
Orders are validated after you helped to check the contents and possibly change from the summary page of your order. Last Click or click of acceptance of your order means that you accept the offer and these terms and conditions. We will acknowledge receipt of your order by email. This email constitutes our registration confirmation of your order. You will receive the ordered product, subject to the availability and / or the acceptance of your order if your application does not comply with our terms of sale. The sale will be considered final after sending the product as well as the collection of the full price. The general conditions of sale apply to your order are those available at the time of your order. These general conditions prevail over all other conditions of sale with the exception of particular conditions “Order at issue” and “Collection” below. 3. Sheet Product & Product Availability
3.1 Product Sheet
The photographs illustrating the products are for reference only. The differences between the products delivered and their photographic representation can be only minimal differences and do not relate to the essential characteristics of the product.

3.2 Product Availability
Our product is valid in the stocks. If, despite our efforts the product is not available in the delivery time specified in the terms of the offer, you will have the option to cancel your order seven days after the expiry of the delivery period indicated. We invite you to consult our Customer Relations department with any questions.

4. Purchase price
All product offerings, services and delivery terms, prices in euros are valid only in metropolitan France and in the stocks. The prices include the French VAT.
All our prices include VAT at the rate of VAT applicable at the time of your order and applicable depending on the nature of your product. Any change in the VAT rate will be reflected in the prices of products offered for sale on the website of Hâpy Collection. The prices of our products and services do not include transportation costs. The payment will be considered final after actual collection of funds.

5. Payment
5.1 General
Except as otherwise provided in the Special Conditions of the product, you have nothing to pay at the time of your order. You pay upon receipt of your products after the expiry review of 14 (fourteen) days.
5.2 Payment Methods
Unless otherwise stated, you can pay:
• by Credit Card with cards bearing the CB logo, brand VISA, EUROCARD or MASTERCARD, online or offline.
As regards the payment online by Credit card Debit: All information about your credit card is highly secured by SSL (Secure Socket Layers). They never circulate on the Internet and do not pass through Hâpy Collection. They are routed in real time on the secure payment manager of our financial partner, which sends an authorization request to the network Bankcard. The payment system delivers an electronic certificate of payment Hâpy Collection. The small icon with a padlock bottom of your browser window to confirm the activation of the secure mode.
5.3 Payment security

6. Delivery and shipping costs
Delivery costs cover the processing of the order, preparing the order, the postal delivery. They are specified in each of our offers (see special conditions of such offers).
The products are delivered to the address specified in your order on the website. Delivery is made within the period specified in each of our offers (see special conditions of such offers). We consider in this time of the delivery time by post, our partner for all our shipments. 7. Return, refund and interruption
7.1 Withdrawal period
You have a withdrawal period of 14 (fourteen) days of receipt of your product. 8. Guarantees Notice – Defective Product
In the event delivery, the product will not prove conformity with your order within the meaning of Article 211-5 of the French Consumer Code, you can, within a period of 2 years from the delivery of the product, return the product at our expense. In case the use, the product would present a hidden defect which would render it unsuitable for normal use within the meaning of Article 1641 of the Civil Code, you may, within 2 years from discovery of the defect , return it at our expense by contacting the Customer Relations service that will send you a postage card. After fault finding, Hâpy Collection will refund the product or a price reduction if you want to keep it. Hâpy Collection is not required to apparent defects which the buyer was able to convince himself.
Hâpy Collection can in no way be considered responsible for any harmful consequences that (s) vice (s) hidden (s) affecting (s) products could result.

9. Reservation
The delivered products remain the property of Hâpy Collection until full payment. The mere submission of a payment does not constitute payment as the banking organization is not credited Hâpy Collection. In the absence of full settlement, Hâpy Collection will be entitled to demand the return of the products. The costs to be incurred for such return will be your responsibility.

10. Responsibilities
Hâpy Collection will not be held liable for breach of contract in case of force majeure as usually recognized by French jurisprudence, disruption or total or partial strike of postal services and transport and / or communication. The domain name “hâpy-collection.com” belongs to CARRHURE.

14. Governing Law and Jurisdiction
All orders are subject to French law. Any order automatically entails your acceptance of our general and special conditions of sale. The consumer can take his choice, in addition to a territorially competent courts under the Code of Civil Procedure, the court of the place where he lived at the time of conclusion of the contract or harmful event occurred.

18. Modifications to the Terms of Sale
Hâpy Collection reserves the right to adapt or modify at any time the terms and conditions of sale. The new General Terms and Conditions will apply to orders placed after this change.
